Terms and Conditions
1. Acceptance of Terms
By booking a service or paying a deposit to D'Legacy Zone, you (the "Client") agree to be bound by the following terms and conditions. These terms constitute a legally binding agreement between the Client and D'Legacy Zone.
2. Irrigation Service & Diagnostic Fee
Diagnostic Visit: We charge an $85 Diagnostic Fee for all irrigation service calls. This fee covers travel, local overhead, and a professional evaluation of the system.
Fee Waiver: If the Client approves and proceeds with a repair exceeding $85 during the same visit, the Diagnostic Fee will be waived. If the repair is under $85, the $85 fee serves as the minimum service call charge.
3. Underground Utilities & Private Lines
Public Utilities: You are required to contact 811 (Texas Excavation Safety System) for public utility marking prior to any major digging (Sod, Masonry, New Installs).
Private Lines (Crucial): D'Legacy Zone is not responsible for damage to private, unmarked underground lines. This includes, but is not limited to: invisible dog fences, low-voltage landscape lighting, pool heater/filter lines, private gas lines for grills, or satellite/internet cables not marked by the city. It is the Client's responsibility to inform us of these lines.
4. Payment & Deposits
Repairs: Payment is due in full immediately upon completion of irrigation repairs.
Large Projects: Projects such as Sod Installation, Masonry, Artificial Turf, or Full System Installs require a 50% non-refundable deposit (within 7 days of start) to secure the date and purchase materials. The remaining 50% is due upon completion of the project.
5. Site Conditions & Access
Access: The Client must provide access to the property and the irrigation controller (timer) at the scheduled time. If the property is inaccessible, an $80 "No-Show" fee may be applied.
Water Source: For all projects, the Client must provide access to a functioning water source and electricity.
6. Live Products (Sod & Plants)
Responsibility: D'Legacy Zone provides high-quality, locally sourced sod and plants. However, once installed, the health and survival of these living products depend entirely on the Client’s watering and maintenance.
No Warranty: We do not offer warranties or replacements for sod that fails due to under-watering, over-watering, pests, or disease after the installation date.
7. Hardscaping & Concrete
Settling: Minor hairline cracks and slight color variations are natural characteristics of concrete and masonry work. These are not considered defects and are not covered under warranty.
Drainage: While we design patios and walkways to shed water, D'Legacy Zone is not responsible for property-wide drainage issues unless specifically contracted to install a drainage system.
8. Limitation of Liability
D'Legacy Zone shall not be held liable for indirect, incidental, or consequential damages arising from the use or inability to use the irrigation system, or from property changes resulting from masonry or sod installation.
9. Governing Law
These terms are governed by the laws of the State of Texas. Any disputes shall be handled in the jurisdiction where the service was performed.
10. Non-Payment, Liens, and Collection Costs
Late Payments: Any balance not paid upon completion of the project is subject to a late fee of 1.5% per month (18% per annum) or the maximum rate permitted by law, whichever is lower.
Debt Collection: In the event of non-payment, D'Legacy Zone reserves the right to transfer the account to a third-party collection agency. You (the Client) agree to be responsible for all collection costs incurred.
Mechanic’s Lien: NOTICE OF RIGHT TO LIEN. D'Legacy Zone reserves the right to file a Mechanic’s Lien against the property where the work was performed in accordance with Texas Property Code Chapter 53 if payment is not received. This lien acts as a legal claim against your property to secure the unpaid debt.
Attorney’s Fees & Legal Costs: If legal action is required to recover unpaid balances, the Client agrees to pay all costs of such collection, including but not limited to: court costs, filing fees, and reasonable attorney’s fees incurred by D'Legacy Zone.
Suspension of Service: D'Legacy Zone reserves the right to suspend all ongoing work and future warranty claims if any payment is past due.
11. Media Release & Promotional Use
Photography & Video: The Client grants D’Legacy Zone permission to take photographs and video recordings of the work performed on the Client’s property.
Usage Rights: The Client agrees that these images and videos may be used by D’Legacy Zone for promotional purposes, including but not limited to: our website, social media platforms (Instagram, Facebook, TikTok, etc.), and marketing materials.
Privacy Protection: D’Legacy Zone agrees to make reasonable efforts to ensure that sensitive information—such as house numbers, street signs, or license plates—is not the focus of the media. We will never share the Client’s full name or internal home photos without additional written consent.
Revocation: If the Client wishes to opt out of this media release, they must notify D’Legacy Zone in writing via email at info.dlegacyzone@gmail.com before the project start date.
12. Service & Repair Terms
Diagnostic & Service Call Fee: A non-refundable Diagnostic Fee of $85.00 is required to secure all irrigation service appointments. This fee covers the technician's travel, fuel, and a comprehensive evaluation of the system, including zones, heads, valves, and timers.
Repair Credit Policy: For repairs over $85.00, the full diagnostic fee will be applied as a credit toward the final invoice. For repairs $85.00 or less, or if the client chooses not to proceed, the $85.00 fee serves as the minimum service call balance.
Client Cancellations: Cancellations or rescheduling by the Client must be requested at least 24 hours prior to the appointment. Failure to provide notice may result in the forfeiture of the diagnostic fee.
Company Cancellations & Rescheduling: D’Legacy Zone reserves the right to cancel or reschedule any appointment at our discretion due to inclement weather, equipment failure, or unforeseen scheduling conflicts. In the event that we must reschedule, we will notify the Client as soon as possible to arrange a new service date.
Payment Methods & Discounts: Online bookings and credit card payments include a standard processing fee. A discounted rate of $80.00 is available for clients who book directly and pay via Cash or Zelle.
13. Right to Refuse Service & Service Area
General Policy: D’Legacy Zone reserves the right to refuse service to any individual or business for any reason at our sole discretion. This includes, but is not limited to, safety concerns, scheduling availability, or project scope.
Irrigation Repair Limit: While we provide large-scale installations across the DFW Metroplex, standard irrigation diagnostic and repair services are restricted to a 25-mile radius from North Richland Hills, TX. Requests for repairs outside this zone may be declined or subject to additional travel surcharges at our discretion.
Project Prioritization: We reserve the right to prioritize projects based on location, service type, and current scheduling capacity to ensure the highest quality of service for our clients.
